Can I copyright what AI helped me create?

Partly, depending on what you contributed. U.S. copyright protects human authorship. It doesn’t extend to material generated entirely by AI, or to material where a person lacks real control over the expressive elements.

Typing a prompt generally doesn’t make you the author of the output. The Copyright Office treats prompts as instructions that convey ideas, and says revising a prompt many times doesn’t change that. The system still decides how the idea is expressed.

What can be protected:

  • Your own original work that shows up in the output, such as a drawing or text you fed into the tool

  • Your creative selection and arrangement of AI-generated material

  • Your creative modifications to AI-generated material

Using AI to assist your work, such as brainstorming, outlining, or editing, doesn’t by itself affect the copyright in what you author. Each case is judged on its facts, so keep records of what you created and how.

Can I trademark a name or logo created with AI tools?

Often, yes. Trademark rights come from using a name or logo in commerce to identify your business, not from who or what designed it. The risks are different. AI tools can suggest names and logos close to existing marks, and a logo made entirely by AI may have no copyright protection of its own, which makes the trademark your main protection. Clearing a name before you launch matters more, not less.

Who owns the work when my team or contractors use AI?

Ownership follows your agreements. Without written IP assignments and a clear policy on AI use, you may not own what your team and contractors produce, or know which tools touched it. Contracts, assignments, and an AI use policy close that gap.
